OFFICIAL RULES FOR SAY AND WIN INSTANT WIN SWEEPSTAKES

1. Overview

The Say & Win Instant Win Sweepstakes (the “Sweepstakes” or “Promotion”) consists of a promotional Giveaway, with a fixed number of Prizes to be awarded over a specified Promotional Period, in which participants qualify to win Prizes by using the application provided on the Say & Win website (the "Site") to update their status messages on social networking sites. To access the Site, go to www.sayandwin.com.

2. Eligibility

a. The Promotion is open to legal residents of the fifty (50) United States (including District of Columbia, but excluding Puerto Rico, US Virgin Islands and US and foreign possessions and territories) who have entered valid and verifiable information upon registration, including an a valid email address.

b. Employees, officers and directors of Publishers Clearing House, and its respective affiliates, distributors, retailers, sales representatives, advertising and promotion agencies (collectively, the "Promotion Entities"), contest supervisors and the immediate family and household members of all such individuals, respectively, are not eligible to enter or win a prize in the Promotion.

c. "Immediate family members" means parents, step-parents, legal guardians, children, step-children, siblings, step-siblings and spouses."Household members" shall mean those people who share the same residence at least three months a year. Void where prohibited or restricted by law.

3. How to enter the Sweepstakes

To be eligible to enter the Sweepstakes, you must register and use the status update application on the Site to update your status message on social networking sites. To register, go to www.sayandwin.com and create an account by providing a valid email address and password. Check to make sure that you correctly entered information in all the required fields on the registration form.

Share what's on your mind with all of your friends on social networking sites like Twitter® and Facebook® by using Say & Win to update your status. Say & Win is not affiliated with Twitter® or Facebook®.

After registering/logging in, you can use the status update application provided on the Say & Win site to connect to your accounts on social networking sites. There is a limit of one win, per IP address, per day. You will be entered to win a prize when you update your status by using the application, up to 25 status updates per day (provided your IP address is still eligible to win a prize on that day). Once a prize attributable to your IP address has been won on a given day, no other updates on that same day will enter you to win a prize.

Winner Selection Methodology: winning times will be randomly selected throughout the promotional period and prizes will be randomly assigned to the winning times. If you are the first person to successfully post an update at or after a winning time during the promotional period, you will win a prize.

In the unlikely event that, due to a system malfunction or other technical error, more than one person is identified as a winner of a single instant-win prize, PCH reserves the right to hold a random drawing to determine the winner of the prize.

5. How to Claim a Prize

a. You will be notified immediately if you have won a prize. To claim your prize, you must follow the instructions in your notification and complete and submit your claim form within 24 hours of winning. Failure to timely and properly claim any prize will result in forfeiture. All unclaimed prizes will be awarded at Giveaway end in a random drawing among all eligible entries. All personally-identifiable information submitted by any winner to claim a prize is subject to the Privacy Policy.

b. Potential winners may also be required to sign an affidavit of eligibility and (except where prohibited by law) consent to publicity, including but not limited to the use of winner's first name, first letter of last name, and location (city and/or state), photograph, or any quotation that the winner is willing to provide without additional compensation, which if requested by Sponsor must be signed, notarized and returned to Sponsor within thirty (30) days of receipt, or prize will be forfeited and remain unclaimed and the potential winner be disqualified.

c. Gift card winners will receive their codes electronically via email. Cash prize winners will be sent their checks via postal mail within 4 to 6 weeks.

6. Publicity

Acceptance of prize constitutes permission to use winner’s name and photograph in television commercials, in website promotions, and for other promotional purposes, unless prohibited by law. Parent or Legal Guardian must act for a minor.

7. General Conditions

By entering this promotion, each entrant accepts and agrees to be bound by these official rules and the decisions of the Board of Judges. Publishers Clearing House, pch.com, Say and Win and their agencies are not responsible for any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with or utilized in the Sweepstakes or by any technical or human error which may occur in the processing of submissions in the Sweepstakes. Publishers Clearing House, pch.com, Say and Win and their agencies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of entries. Publishers Clearing House, pch.com, Say and Win and their agencies are not responsible for any problems or technical malfunction of any telephone network or lines, computer systems, servers or providers, computer equipment or software on account of technical problems or traffic congestion on the Internet or combination thereof, including injury or damage to participants or to any other person's computer related to or resulting from participating or downloading materials in this Sweepstakes. If the Sweepstakes is not capable of running as planned for any reason, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other cause beyond the control of Publishers Clearing House, pch.com and/or Say and Win which corrupts or affects the administration, security, fairness, integrity or proper conduct of this Sweepstakes, Publishers Clearing House and pch.com and/or Say and Win reserve the right to terminate the online portion of the promotion. Entries become the property of Publishers Clearing House and pch.com and/or Say and Win and will not be returned.

Publishers Clearing House and pch.com reserves the right through decision by the Board of Judges to disqualify any entry determined to be the result of tampering with the pch.com system and/or Say and Win in violation of the letter and spirit of the official rules. Any use of programmed, automatic or scripted entry methods will void all associated entries and individuals using such methods may be disqualified for future entry opportunity.

8. Disputes

Decisions of the Board of Judges are final. In the event of a dispute as to any entry, the authorized account holder of the email address used to update will be deemed to be the entrant. Failure by Publishers Clearing House, pch.com and Say and Win to enforce any provision in these Official Rules shall not constitute a waiver of that provision.
